Everydrop Technologies Product Warranty

Warranties are NON-TRANSFERABLE. Sales of used or second-hand products from unauthorized dealers or resellers will not be covered by this warranty.

MATERIALS AND WORKMANSHIP

Everydrop Technologies warrants Product to be free from defects in materials and workmanship under normal use and service for earlier of following: one (1) year after installation or two (2) years after shipment from Everydrop Technologies. The warranty does not apply to products that are the subject of negligence, accident or damage by circumstances beyond Everydrop Technologies’ control; or any improper operation, maintenance, storage, installation or use. This includes, but is not limited to, cracking of the meter body due to freezing water.

PRODUCT RETURNS

Product failures must be proven and verified to the satisfaction of Everydrop Technologies, LLC. The obligation of Everydrop Technologies hereunder shall be limited to such repair and replacement and shall be conditioned upon the following:

Everydrop Technologies receiving written notice of any alleged defect within ten (10) days after its discovery by emailing sales@everydropmeters.com.
Everydrop Technologies must receive the defective product within (30) days of receiving the written notice.
The customer must comply with Everydrop Technologies’ return shipping instructions including getting an RMA number from Everydrop Technologies.
The customer will pay for any shipping charges for Products returned by you to Everydrop Technologies.
The customer must return the defective product prior to receiving the replacement. If the customer is unable to return the product, the customer must place an order for a new product after receiving an RMA number from Everydrop Technologies. Once the original product has been inspected by Everydrop Technologies and determined to have a manufacturing defect, the customer will be refunded for the full cost of the replacement meter.
If the customer chooses to purchase a meter rather than wait for inspection, and if the returned meter is deemed to be operational, then the customer will be charged a $40 restocking fee upon refund of the purchased unit.
The customer shall be responsible for all direct and indirect costs associated with removing the original Product and reinstalling the repaired or replacement Product.

LIMITS OF LIABILITY

This warranty shall not apply to any Product repaired or altered by any Party other than Everydrop Technologies. The foregoing warranty applies only to the extent that the Product is installed, serviced and operated strictly in accordance with instructions from Everydrop Technologies. The warranty shall not apply and shall be void with respect to Product exposed to conditions other than those detailed in Product technical literature, or which have been subject to vandalism, negligence, accident, acts of God, improper installation, operation or repair, alteration, or other circumstances which are beyond the reasonable control of Everydrop Technologies. With respect to equipment and parts not manufactured by Everydrop Technologies, the warranty obligations of Everydrop Technologies shall in all respects conform and be limited to the warranty extended to Everydrop Technologies by the supplier. The customer shall use the Product at his own discretion and risk. Customer will be solely responsible for any and all loss, liability, or damages. This includes, but is not limited to, plumbing, water lines, and all sprinkler system components.

THE FOREGOING WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS AND IMPLIED WARRANTIES WHATSOEVER, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Any description of the Product, whether in writing or made orally by Everydrop Technologies or agents of Everydrop Technologies, specifications, samples, models, bulletins, drawings, diagrams, engineering sheets or similar materials used in connection with any order from the Customer are for the sole purpose of identifying the Product and shall not be construed as an express warranty. Any suggestions by Everydrop Technologies or agents of Everydrop Technologies regarding use, application or suitability of the Product shall not be construed as an express warranty unless confirmed to be such in writing by Everydrop Technologies.

Exclusion of Consequential Damages and Disclaimer of Other Liability

The liability of Everydrop Technologies with respect to breaches of the foregoing warranty shall be limited as stated herein. The liability of Everydrop Technologies shall in no event exceed the Product price paid by the original user. EVERYDROP TECHNOLOGIES
SHALL NOT BE SUBJECT TO AND DISCLAIMS: (1) ANY OTHER OBLIGATIONS OR LIABILITIES ARISING OUT OF BREACH OF CONTRACT OR OF WARRANTY, (2) ANY OBLIGATIONS WHATSOEVER ARISING FROM TORT CLAIMS (INCLUDING NEGLIGENCE AND STRICT LIABILITY) OR ARISING UNDER OTHER THEORIES OF LAW WITH RESPECT TO PRODUCTS SOLD OR SERVICES RENDERED BY EVERYDROP TECHNOLOGIES, OR ANY UNDERTAKINGS, ACTS OR OMISSIONS RELATING THERETO, AND (3) ALL CONSEQUENTIAL, INCIDENTAL AND CONTINGENT DAMAGES WHATSOEVER.
